These terms apply to passenger transport bookings made with FlyAway Cars Ltd (“Flyaway Cars”, “we”, “us”). By confirming a booking, the person making it agrees to these terms for themselves and every passenger in the party.
1. Quotes and bookings
A website booking-form submission or initial quote is not a confirmed booking. A booking is confirmed only when we have accepted it, agreed the journey details and price, and received any payment we require.
You must give us complete and accurate pickup, destination, date, time, passenger, luggage and flight information. Tell us promptly if anything changes. We may decline a request where no suitable driver or vehicle is available.
2. Prices and payment
Your confirmed quote covers the agreed journey and vehicle. Unless we say otherwise, payment is required when booking. We may charge reasonably for changes such as extra stops, waiting time, a larger vehicle, additional mileage or changes made after confirmation.
Airport parking, tolls, congestion charges and drop-off fees will be included where known or explained separately. Charges caused by circumstances not reasonably known at the time of quoting may be added at cost.
3. Vehicles, passengers and luggage
Vehicle makes and models shown on our website are examples. We may provide a comparable or upgraded vehicle. You must tell us about all passengers, suitcases, pushchairs, mobility equipment and oversized or unusual items. We may refuse unsafe loads or charge for an additional vehicle where the declared vehicle cannot legally or safely carry the party.
Seatbelts must be worn. You are responsible for ensuring children use an appropriate restraint as required by law. We do not routinely provide child seats. If we agree to store your seat between outward and return journeys, we do so as a courtesy; you remain responsible for its condition and correct fitting.
4. Pickup, flights and waiting
For journeys to an airport, the driver will wait for 15 minutes after the agreed pickup time without charge. After that, standard vehicles may be charged £10 per additional 15 minutes. If a delay exceeds 30 minutes and we cannot continue to wait, the booking may be treated as a no-show.
For airport collections, we will use the flight details you supply to monitor the expected arrival time. Flight monitoring does not guarantee that we can accommodate every delay. You must contact the driver or office if your circumstances change after landing and follow the agreed meeting instructions.
5. Cancellations, changes and no-shows
You may cancel for a full refund up to 24 hours before the scheduled pickup. Cancellations within 24 hours are non-refundable unless we agree otherwise. Any refund will normally be returned to the original payment method.
If you do not attend the agreed pickup point, do not respond to reasonable contact attempts, or provide details that prevent us completing the journey, we may treat the booking as a no-show and no refund will be due.
If we need to cancel because we cannot provide the journey, we will refund the amount paid for the affected service. We will contact you as soon as reasonably possible.
6. Passenger behaviour
Drivers may refuse or end a journey where a passenger is abusive, threatening, excessively intoxicated, behaving unlawfully, or creating a safety or health risk. Smoking and vaping are not permitted. The booking customer is responsible for reasonable cleaning, repair or loss-of-use costs caused by the party, including spillages, sickness and damage.
7. Delays and events outside our control
We plan journeys with reasonable care but cannot guarantee arrival times where events outside our reasonable control intervene. These may include severe weather, exceptional traffic, accidents, road closures, airport disruption, security incidents, industrial action and public authority decisions.
Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence or for fraud. Subject to that, we are not responsible for indirect or consequential loss. Our total liability relating to a booking will not exceed the price paid for it, except where the law requires otherwise.
8. Personal information
We use personal information to quote, arrange and deliver journeys, take payment, communicate with passengers and meet legal obligations. Our privacy policy explains this in detail.
9. Complaints and contact
Please raise any problem as soon as possible so we have a fair opportunity to help. Contact us at info@flyawaycars.com or 0116 456 0709. We aim to acknowledge written complaints promptly.
10. General terms
If a court finds part of these terms unenforceable, the remaining terms continue to apply. A delay in enforcing a right is not a waiver. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, subject to any mandatory consumer rights.
